From her pavilion in Chécy, Nelly, 78, is desperate to one day make her brother’s admittedly delicate situation understandable to her bank, but not so complicated to integrate. With 20 euros, which have been taken several times a month since May, “Misunderstanding” amounted to 1,000 euros bank charges on August 4th. “And there’s no way to be heard!”
For clarity, let’s rewind four months earlier.

“Very difficult to get to”
On March 22, 2022, the brother of this Chécy resident died at the age of 66 placed under “protection” by court order. The procedure is a prerequisite for a possible placement under guardianship or foster care, which is decided by the guardianship judge.
“My brother had a difficult divorce which he came through very badly, he was several thousand euros in debt…so earlier this year he voluntarily agreed to be admitted to a psychiatric hospital. .” The protection procedure will therefore be decided at the end of this hospitalization and an agent, through whom the Loiret must now pass for all acts of daily living, will be appointed by the courts.
4,000 euros in the account but no payment accepted
Problem: Boursorama, Nelly’s brother’s bank, never seemed to understand how the system worked. “As soon as the backup procedure was announced, my brother’s overdraft facility authorization was revoked. then They then blocked all withdrawals from his account beginning in May. There is absolutely no payment that has been accepted for three months. Some are of course indispensable: health insurance, electricity supplier, telephone operator, insurance or just for shopping!”
Nelly’s brother, on the other hand, gets his pension well (2,200 euros per month). And the account is covered: it was just over 4,000 euros then until August 4th.
“But Boursorama has not only blocked all direct debits, but withholds a penalty of 20 euros for each refusal. These penalties now amount to 1,000 euros.”
Difficult to defuse the situation: “They’re very hard to get hold of, apart from Eliott, their virtual little guy. When I call, I’m told I can’t access my brother’s accounts. Neither can he because he is under legal protection. As for her deputy… either she can’t reach her either – which she explained to us – or she’s not doing what’s necessary! When we point this out to her, she tells us that my brother isn’t the only file she has to deal with. But I, my brother, he has to eat every day!”

“Where would he be? On the street?”
Nelly’s feelings fluctuate between anger and despair. “This situation puts us all in a very complicated situation. I help my brother as much as I can, I paid his last rents, but at 78 it’s not easy.”
“If I wasn’t there, where would he be? On the road? We had no choice but to register him at Restos du Coeur. He decided to sell his electric bike, his trailer, to get some money back. But so did he sold his wedding ring and signet ring.”
Some of the Loiretaine’s anger is directed at online banks: “In the beginning we think it’s great, we generally have fewer bank fees. But where in traditional banks we have personal advisors, in online banks we have nothing. You shouldn’t have the slightest problem with that!”
You “don’t play the game”
If the representative of Nelly’s brother did not want to comment in detail, she nevertheless “acknowledges that Some banking organizations, including online banks, do not play the game of accessing banking information, however provided for in the law”.
“It harms the adults, not to mention the management of their administrative and financial files psychological effects such a situation.”
Contacted by The Republic of the Middle Saturday, August 6th boursorama didn’t answer at first. But following our inquiries, the company announced it would have this Monday, August 8th reintroduced all direct debits from bank accounts Nelly’s brother; refunded the 1,000 euros bank charges; have performed a commercial gesture of 200 euros.
